It can be very confusing at times to understand some of the subtle differences for those with “distressed” properties – those where the price or the payments have become a challenge for the homeowner.

In a Short Sale, the value of the home has fallen below the balance due on the home loan mortgage, and the owner is either unwilling or unable to keep paying and wants to sell.  Also known as being upside down on your properties.  What is the process?  It goes mostly like this:

1)  The home seller hires a selling short real estate agent to attract offers

2) The agent accepts reasonable offers and sends them to the bank that holds the note on the property for approval

3) If the offer is accepted, the Buyer Agent and the Listing Realtor get their commission, the bank sells to the new Buying party and the Bank takes a loss on the mortgage on the books.

4) The current owner of the house gets nothing, but the financing for home is closed out and no more payments are due. 

Some exceptions to this general rule occur, but most short sales occur in this type of procedure.

How does this differ from a foreclosure.  What is being foreclosed versus selling “short” for a Seller?

In a foreclosure, the owner has gotten behind in payments by at least 90 days.  Once they are ninety days late, then bank that holds the mortgage has the right (but not the OBLIGATION) to take back the home and evict the current homeowners.

1) the bank begins foreclosure proceedings, warning the resident that they will be foreclosed upon and will have to move out

2) a waiting period begins and at the end of this period the bank takes over ownership of the real estate and then can evict the homeowner

3) the bank then holds this property as Real Estate Owned or REO on their books and usually will sell it quickly in an auction process where many investors line up to buy at a deep discount

We focus on helping for sale by owner sellers to sell but when a homeowner is behind in payments or sees no point in paying for a mortgage that is higher than the home’s worth or value, different home sales procedures are used.
